These Terms and Conditions (the "Agreement") govern the provision of real estate photography services (the "Services") by House Trekker, a photography agency located in Ontario (the "Agency"), to the Client.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

Scope of Services: The Agency shall provide the Client with real estate photography services in accordance with the terms and conditions set forth herein.

Payment: The Client shall pay the Agency the fees agreed upon by the parties for the Services rendered. The payment shall be paid 100% prior to the appointment.

Cancellation Policy: The Client may reschedule the shoot up to 24 hours prior to the scheduled time without incurring additional fees. If the Client cancels or rescheduled within 24 hours of the scheduled time, a fee of $100 will be charged.

Intellectual Property: The Client acknowledges that all intellectual property rights in the photographs taken by the Agency pursuant to this Agreement shall remain the property of the Agency. The Client shall have a limited license to use the photographs for the purposes of marketing and promoting the property depicted in the photographs.

Liability: The Agency shall not be liable to the Client for any indirect, special or consequential loss or damage arising out of or in connection with this Agreement or the Services provided, including but not limited to loss of profits or loss of business, even if such loss was foreseeable by the Agency.

Indemnification: The Client shall indemnify and hold harmless the Agency from and against any and all claims, damages, expenses, or liabilities arising out of or in connection with the Client's use of the photographs or floor plans taken by the Agency.

Confidentiality: The Agency shall keep confidential any information disclosed by the Client in connection with this Agreement and shall not disclose such information to any third party without the Client's prior written consent.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Entire Agreement: This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, representations, or agreements between the parties, whether oral or written.

Amendments: This Agreement may only be amended by written agreement signed by both parties.
